Probably ought to mention author expectation too. I recall someone arguing that we ought to have copyright law because authors expect to be paid. A good answer to this is that any difference between what authors would be paid without copyright law, and what they expect to be paid with copyright law is a consequence of copyright law, not a justification for it, IMHO.
Also, I've said "Traditionally, when possession of property is transferred with no intent of later reclaiming possession, ownership is considered to have been transferred." I think this is right. I think this is abandonment/dereliction or similar. (And I suspect the copyright doctrine of first-sale is kind of a pale reflection of this.) Can anyone more clued up on this clarify? (I guess this might not apply to rented DVDs though, if the video store required otherwise.)
Another thing that I've seen argued is that privacy can only be justified on the basis on intellectual property rights. This can be addressed by pointing out that you can't sell your privacy such that it becomes someone else's privacy.
